Whalley lieutenant's '?220K fraud' paid for son's Stonyhurst College fees

A HIGH-RANKING Army officer claimed nearly ?220,000 of tax payers? money to send his three children to a top public school, a court heard.

For nearly a decade Lt Col Robert Jolleys, 52, claimed the school fees so he could send his sons to Stonyhurst College.

Swindon Crown Court heard that Jolleys was not entitled to make the claims because he was separated from his wife Judith.

Jurors were told that Jolleys, from Whalley, kept up an elaborate charade by maintaining to his superiors that he was still married and that his wife lived with him in his Army quarters. In reality they had split in 2002.

Jolleys' ruse was only rumbled when his estranged wife rang his superior officer in the summer of 2009 and asked 'Where's Robert?'.

Prosecutor Nicolas Gerasimidis told the court that Jolleys then realised the ?balloon had gone up? and set about trying to cover his tracks.

He left the Army the following year.

Mr Gerasimidis said: "Lt Col Jolleys, as he then was, was taking advantage of an allowance by virtue of his posting to get the children's education paid for.

"It really is as simple as that. The prosecution say he was not entitled to it and the prosecution will have to prove it.

"Lt Col Jolleys was a senior officer in the Army and a highly intelligent and clever man and was working in the Directorate of Education Training Services around this area in Swindon."

Mr Gerasimidis said that the Continuing Education Allowance was set up to avoid the children of armed forces personnel having their education disrupted when their parent was posted overseas or away from the family home. It allowed servicemen or women to claim up to 90 per cent of the costs of a boarding school education.

"That type of schooling would otherwise be unaffordable to those earning the sort of money Lt Col Jolleys was earning," Mr Gerasimidis said.

"Stonyhurst College is a very impressive school.

"It is precisely the sort of place you would want your children to go and for that reason it is extremely expensive."

Mr Gerasimidis told the jury of six men and six women to look at the sums of money on the indictment and added: "When you look at the eye watering amounts of money in this case, in this case it was for the education between 2002 and 2010."

The court heard there were strict criteria for claiming the allowance and as soon as Jolleys split from his wife he no longer qualified.

Jolleys, of Woodlands Park, denies all 11 charges, which happened between January 2002 and December 2009.

He is accused of five charges of obtaining a money transfer by deception, three charges of fraud and three charges of forgery.

Mr Gerasimidis told the court that Jolleys claimed a total of ?218,094.11 in school fees over nearly eight years - a bill picked up by the taxpayer.

The prosecutor said it was a ?complete quirk? that the deception was uncovered by the Army in the summer of 2009.

"This defendant's commanding officer Colonel Russell received a telephone call from Judith Jolleys," Mr Gerasimidis said.

"The last thing he expected was a telephone call asking 'Where's Robert?'.

"That telephone call came as a complete surprise to him and as his commanding officer he was labouring under the impression that the Jolleys were married and together, the children were at boarding school and they held a married quarters at Upavon.

"He only held a married quarters as part of the requirement that only married couples live in married quarters.

"It was part of the sham, the prosecution say, to give the impression he was married."

When the Army investigation began, Jolleys applied in January 2010 for premature voluntary release, the court heard.

Mr Gerasimidis said that each time Jolleys submitted a claim for school fees he signed paperwork saying he was still married.

He went on to explain to the jury that Army personnel could still claim the allowance even if they were separated, widowed or divorced provided they were the primary carer for the children.

The prosecutor said that Jolleys would be telling the jury that he was the primary carer and therefore entitled to make the claims.

And before he left the Army he tried to retrospectively make an application saying that he was the primary carer but that was turned down.

Mr Gerasimidis described the defence as a "red herring" and accused Jolleys of ?bullying? his estranged wife into agreeing that he was the children's primary carer.

Mr Gerasimidis said that during subsequent divorce hearings Jolleys tried to make out that his wife was an unfit mother and accused him of ?manipulating? the proceedings to support his assertion that he was the primary carer.

To support his claims of being the primary carer, Jolleys is also accused of forging his wife's signature on official documents.

S.African assets buckle as platinum workers strike

JOHANNESBURG (Reuters) - The South African rand weakened against the dollar and investors pushed bonds lower on Wednesday due to brewing labour unrest in the platinum sector that was threatening to hurt the crucial mining sector of Africa's largest economy.

South African workers at the world's biggest producer of the white metal, Anglo American Platinum, refused to report for overnight duty on Tuesday after their employer's announcement that 14,000 jobs would be cut and four shafts closed indefinitely.

Investors dumped bonds, driving the yield of the benchmark 13-year paper 7.5 basis points higher to 7.21 percent at 0627 GMT. The two-year bond's yield rose 5.5 basis points to 5.38 percent.

The rand slid 0.5 percent to a six-week low of 8.8605 at 0610 GMT.

"We would not be surprised if it continued to weaken to 8.90 to the dollar over the coming days. Proposed job losses within the platinum sector are at the heart of the latest wave of rand bearishness," Absa Capital said in a note.

Amplat's decision could trigger a fresh wave of wildcat strikes similar to the one that swept through the platinum and gold sectors last year, leaving more than 50 people dead and slowing South Africa's economic growth.

The government, which stands to lose substantial amounts of money from tax and royalty income, came out against Amplat's proposed cuts.

Fitch ratings agency dropped South Africa's credit rating by a notch last week, citing among other things, uncertainty in the mining sector.

Investors will be watching retail sales and manufacturing numbers scheduled for release on Wednesday for direction but events in the mining sector were still weighing on sentiment.

"The prior highs of 9.010 are looking increasingly realistic and whilst they might not be reached today, they could be by the end of the week if yesterday's market performance is repeated," Traditional Analytics said in a note.

Ghana find top form ahead of Africa Cup of Nations

Ghana continued an impressive build-up to the 2013 Africa Cup of Nations by storming back and defeating fellow qualifiers Tunisia 4-2 in Abu Dhabi at the weekend.

Togo captain Emmanuel Adebayor opted to play for Tottenham in the English Premier League, leaving his countrymen to snatch a 2-1 victory over Niger in a Lome clash of Cup minnows.

Zambia coach Herve Renard says he is not impressed by main first round rivals Nigeria and South Africa handler Gordon Igesund insists his team can be crowned African champions despite another dismal showing.

The championship kicks off Saturday at the 93,000-seat Soccer City stadium in Soweto when South Africa face debutants Cape Verde, and perennial 'chokers' Ivory Coast are title favourites for the fifth consecutive Cup of Nations.

Berlusconi group leads in key region ahead of Italy vote

ROME (Reuters) - Silvio Berlusconi's center-right coalition is leading in a vital battleground region ahead of next month's Italian election, making it harder for left-wing rivals to form a stable parliamentary majority, according to a poll on Sunday.

Whoever wins the February 24-25 vote will have to tackle a deep recession and rising unemployment in the euro zone's third-largest economy as well as keeping strained public finances under control.

If the result in the northern region of Lombardy were confirmed, it could increase the chances of a post-election deal between the center-left Democratic Party (PD), which is leading in national opinion polls, and outgoing Prime Minister Mario Monti's centrist formation.

According to the survey in Sunday's Corriere della Sera, the alliance of Berlusconi's People of Freedom (PDL) party and the pro-devolution Northern League had 35.7 percent support in Lombardy, home to Italy's financial capital Milan.

The center-left bloc made up of the PD led by Pier Luigi Bersani and its leftist allies had 32.3 percent support, the poll by the respected ISPO institute showed.

The poll is important because Lombardy has more seats in the 315-member Senate than any other region and is thus one of the keys to control of the upper house.

The bitter experience of the last center-left government under Romano Prodi, which collapsed less than halfway through its term in 2008 because its wafer-thin Senate majority disappeared, underlines the importance of the race.

The PD is expected to win control of the lower house of parliament, helped by a complicated electoral system that guarantees the biggest party a 54 percent majority of seats, but the Senate race is decided by separate battles in each region.

The PD has pledged to stick to public finance targets that Monti has agreed with Italy's European partners and says it will maintain his broad reform course if it wins the election on February 24-25, but wants greater emphasis on social justice and growth.

Monti has criticized some elements of the left as hostile to reform, prompting increasingly acerbic responses from Bersani and other center-left leaders, but relations between the two sides have been much more cordial than those with Berlusconi.

Neither side has said openly that it would form an alliance if the center-left cannot control the upper house and many on the left are deeply opposed to Monti's austerity policies.

But failure to gain outright control of the Senate would leave Bersani with little choice.

NEWTOWN, Conn. (AP) ? Newtown residents are divided on what to do with the school building where 26 people were killed, with some favoring demolition and construction of a memorial and others encouraging renovations.

Many passionately gave their opinions at an emotional public meeting Sunday about the fate of Sandy Hook Elementary.

"I have two children who had everything taken from them," said Audrey Bart, whose children attend the school but weren't injured in the shooting. "The Sandy Hook Elementary School is their school. It is not the world's school. It is not Newtown's school. We cannot pretend it never happened, but I am not prepared to ask my children to run and hide. You can't take away their school."

But fellow Sandy Hook parent Stephanie Carson said she can't imagine ever sending her son back to the building.

"I know there are children who were there who want to go back," Carson said. "But the reality is, I've been to the new school where the kids are now, and we have to be so careful just walking through the halls. They are still so scared."

The meeting at Newtown High School drew about 200 people. A second meeting is set for Friday. Town officials also are planning private meetings with the victims' families to get their input.

Police say Adam Lanza, 20, killed 20 first-graders and six adults in the Dec. 14 massacre at Sandy Hook. They say he killed his mother at the home they shared in Newtown before opening fire with a semiautomatic rifle at the school and killing himself as police arrived.

Although opinions were mixed at the Sunday meeting, most agreed that the Sandy Hook children and teachers should stay together. They've been moved to a school building about seven miles away in a neighboring town that has been renamed Sandy Hook Elementary School.

Mergim Bajraliu, a senior at Newtown High School, attended Sandy Hook, and his sister is a fourth-grader there. He said the school should stay as it is, and a memorial for the victims should be built there.

"We have our best childhood memories at Sandy Hook Elementary School, and I don't believe that one psychopath ? who I refuse to name ? should get away with taking away any more than he did on Dec 14," he said.

Last week, residents around town expressed similar opinions about the school's future.

"I'm very torn," said Laurie Badick, of Newtown, whose children attended the school several years ago. "Sandy Hook school meant the world to us before this happened. ... I have my memories in my brain and in my heart, so the actual building, I think the victims need to decide what to do with that."

Susan Gibney, who lives in Sandy Hook, said she purposely doesn't drive by the school because it's too disturbing. She has three children in high school, but they didn't attend Sandy Hook Elementary School. She believes the building should be torn down.

"I wouldn't want to have to send my kids back to that school," said Gibney, 50. "I just don't see how the kids could get over what happened there."

Fran Bresson, a retired police officer who attended Sandy Hook Elementary School in the 1950s, wants the school to reopen, but he thinks the hallways and classrooms where staff and students were killed should be demolished.

"To tear it down completely would be like saying to evil, 'You've won,'" the 63-year-old Southbury resident said.

Residents of towns where mass shootings occurred have grappled with the same dilemma. Some have renovated, some have demolished.

Columbine High School, where two student gunmen killed 12 schoolmates and a teacher, reopened several months afterward. Crews removed the library, where most of the victims died, and replaced it with an atrium.

On an island in Norway where 69 people ? more than half of them teenagers attending summer camp ? were killed by a gunman in 2011, extensive remodeling is planned. The main building, a cafeteria where 13 of the victims died, will be torn down.

Virginia Tech converted a classroom building where a student gunman killed 30 people in 2007 into a peace studies and violence prevention center.

An Amish community in Pennsylvania tore down the West Nickel Mines Amish School and built a new school a few hundred yards away after a gunman killed five girls there in 2006.

Newtown First Selectwoman E. Patricia Llodra said that in addition to the community meetings, the town is planning private gatherings with the victims' families to talk about the school's future. She said the aim is to finalize a plan by March.

"I think we have to start that conversation now," Llodra said. "It will take many, many months to do any kind of school project. We have very big decisions ahead of us. The goal is to bring our students home as soon as we can."
